His practice spans from telecom and life sciences to mechanical and chemical fields. Gertjan litigates before national and supra-national courts, the EPO as well as in arbitration. He has extensive experience in conducting and coordinating multi-jurisdictional litigation. Gertjan for example, was the lead lawyer assisting the world's leading coffee company with breaking the Nestlé's monopoly on Nespresso(r) compatible coffee capsules in all major markets. Gertjan also assisted a specialty pharmaceutical company reclaiming entitlement to an invention (and the worldwide patent portfolio protecting it) misappropriated by a former employee and its companies. Also in the SEP area Gertjan has been quite active, including on the competition law aspects.
Gertjan is a real teamplayer and easy to work with. "Gertjan Kuipers is a stellar litigator and analyst who has a very sharp eye for developing the right strategy for each situation. While in litigation, you want to have Gertjan in the driver’s seat!’ a client commented to Legal 500.
Besides litigation, Gertjan also advises on contractual matters including joint R&D and licensing. As a client noted in Legal 500: "Gertjan Kuipers is a highly intelligent, business savvy lawyer and one of the best negotiatiors I have ever worked with."
Gertjan regularly publishes on IP matters such as in the Kluwer Handbook on Patent protection for Second Medical Uses. He chairs AIPPI’s Special Committee on Standards and Patents and is involved in training programs for lawyers, patent attorneys and judges. Gertjan is the founder and chair of the yearly Patent Law Congress in the Netherlands.
