Unlocking the Future: Navigating the UPC
Please join us for our international webinar series.
The Unified Patent Court is now established as a central part of the European patent system. According to the UPC’s website, it has already received a total of 476 cases by the end of August and the first substantive decisions in proceedings on the merits have been issued. In our next webinar, we will dive into the latest learnings that our lawyers have gained during their extensive work on UPC cases and provide views on the latest developments.
Our next UPC webinar on October 8 will focus on the following topics:
- Milan Central Division
The Milan Central Division officially opened its doors in June 2024. Since then, at least one case has been launched before the newly appointed judges (Insulet v. EOFLOW). We briefly discuss the Court's tasks and composition, while waiting for the first decisions to be issued.
- First insights into the assessment of patent validity by the UPC
In the meantime, the UPC has issued its first decisions dealing with patent validity assessment issues. The purpose of this presentation is to give an insight into the first decisions and to compare the approach of the UPC with that of the EPO.
- UPC International Jurisdiction
The precise scope of the international jurisdiction of the UPC is still highly debated. A few recent cases – including Sibio Technology vs. Abbott Diabetes Care and Sling TV v. Aylo Premium – provided some initial answers which are worth analysing in depth.
- Transparency of UPC proceedings
The number of third party requests for being granted access to written pleadings and evidence is constantly rising and questions of “transparency” have attracted more and more attention. While transparency can be a concern for some, it provides valuable insights for others. In this section, we therefore discuss recent case law on this question, thereby also addressing what to include in a request for access and ways to defend against it.
