On 10 October 2024, the Council of the European Union has adopted a Directive to update the EU’s current civil liability regime which is based on the Product Liability Directive from 1985.
The updated Directive aims to modernize the existing liability regime, in particular in the light of past and future technological developments as well as the challenges faced by plaintiffs in proving a claim. According to the updated Product Liability Directive, the new rules not only take into account new technologies, but also aim to make it easier for consumers to claim and enforce compensation for damages for defective products.
