In Italy, “green IP” is on the rise. High-end brands, for instance those in the fashion industry, are becoming more and more eager to adopt sustainable strategies. Still, “green IP” raises a number of challenges, such as identifying the best IP right to protect with, striking the difficult balance between exclusivity and adherence to standards, and finding the correct way to promote a sustainable product or process, while avoiding “greenwashing”.
But what is “green IP”? In short, it is the array of IP rights protecting a green technology. It encompasses all available IP rights, ranging from patents and utility models to designs and trade secrets, as a means to protect sustainable products or processes.
