Byron Phillips is a seasoned disputes lawyer and strategic advisor based in our Hong Kong office, with nearly fifteen years of experience in resolving critical issues for clients. He has a particular focus on complex commercial arbitration and litigation, financial services investigations, white-collar crime and fraud, insolvency litigation, and professional liability disputes for both public and private sector clients.

Byron has a keen interest and extensive experience in technology-related arbitration and litigation, cybersecurity, data privacy and all aspects of digital transformation. As technology continues to influence all areas of law, including litigation, arbitration, and investigations, Byron collaborates with clients to help them navigate their evolving risk landscapes. He ensures they leverage technology effectively to mitigate these risks.

In addition, Byron advises private capital investors on investment, shareholder, and partnership disputes, as well as regulatory considerations across the region.

Byron leads the Asia Pacific Pro Bono Practice at Hogan Lovells, with a passionate commitment to community investment. He is also a member of the Hogan Lovells Crisis Leadership Team, the firm’s global, multi-disciplinary crisis management practice, and holds senior positions in the firm’s Diversity, Equity and Inclusion initiatives.

Representative experience

Advising the Receivers of a Cayman Islands-registered private equity fund in various multi-jurisdictional arbitration and litigation proceedings and to preserve and recover assets.

Acting for the trustee in the default of US$450 million 6% guaranteed bonds issued by an offshore subsidiary of Tsinghua Unigroup, backed by a keepwell deed and equity interest purchase undertaking.

Acting for a Japanese company in a high value commercial ICC arbitration in the Life Sciences sector.

Advising and acting for financial institutions and private equity funds in respect of complex multijurisdictional investigations and recovery actions.

Acting for the Hong Kong holding company of a global fisheries business relating to a shareholder dispute and various ancillary disputes.

Acting for the Joint & Several Liquidators of PeaceMark Holdings Limited (In Compulsory Liquidation).

Acting for victims of cyber fraud, malware attacks and data breaches in investigations, and pursuing global recovery actions.

Acting for a Venezuelan bank in the recovery of monies stolen through malware-related cyber fraud.
