She has counseled on a range of health privacy related issues, including HIPAA implementation and compliance, privacy assessments, privacy governance, breach incidents, HIPAA structural issues, AI and machine learning, and web tracking technologies.
Melissa's extensive knowledge of the health care system and health technology has been an enormous asset to her clients. She helps health care companies, pharmaceutical and device manufacturers, labs, providers, health plans, health information technology companies, wellness companies, and academic medical centers comply with the regulations that impact their products, services, and research. Along with her deep understanding of HIPAA, Melissa also regularly counsels clients on state privacy, sensitive conditions, consumer data protection, and breach notification laws. She also advises on other federal privacy laws including the substance use disorder regulations (Part 2) and the Genetic Information Nondiscrimination Act (GINA). She regularly works with clients on uses and disclosures of data, covered entity and business associate compliance, de-identification, fundraising, genetics privacy and testing issues, and research. Melissa also advises employers on compliance with HIPAA with regard to their self-insured group health plans, and companies and health care entities on compliance with the EU General Data Protection Regulation (GDPR).
As counsel in our Privacy and Cybersecurity group, Melissa also assists genomics research companies and manufacturers with their regulatory compliance and HIPAA. While in law school at Georgetown University Law Center, she was a first-line editor of the Tax Lawyer. She is a lifelong resident of the Washington, D.C. area.
